Patent Law Updates-Status
As many of you know, the USPTO is proposing several new rule changes, which may affect your ability to file for protection of your inventions, and improvements thereof. In summary, the rule changes are targeting three different areas: 1. Continuation Practice; 2. Number of claims prosecuted per application; and 3. Information Disclosure Statement (IDS) Practice. These new rules are only in the proposal stage, but it is anticipated that many of these rules will be passed. The actual date of passage is still up for speculation, but some PTO officials have indicated that passage of at least some type of IDS rule change may occur in early 2007. The PTO has indicated that at least a 30 day notice period will be provided before any of these rules are made effective.
