Japan Shortens Time for Requesting Examination

For any client that has previously filed in Japan or plans on filing in Japan, we want to bring your attention to a recent change in Japanese patent law.

Effective October 1, 2001, the period allowed for filing a Request for Examination after filing of an application will be reduced from 7 years to 3 years from the filing date. In Japanese national filings from PCT cases, the 3 years is calculated from the international filing date.

For applications filed before October 1, 2001, the existing 7 year period will remain in force.
